"Electric service is a human right, and there is a violation of international treaties and our Constitution", stated Gabriela Carpineti, National Director of Promotion and Strengthening for Access to Justice. En este contexto de incertidumbre es importante visibilizar la afectación a derechos humanos fundamentales como el acceso al servicio de luz eléctrica y al servicio de agua potable. En el marco del Aislamiento Social Preventivo y Obligatorio (ASPO), los cortes de luz y suministro de agua que afectaron la zona el Área Metropolitana de Buenos Aires expusieron aún más la vulnerabilidad y la desigualdad social en la que viven amplios sectores de la población.
La Dirección Nacional de Promoción y Fortalecimiento para el Acceso a la Justicia consideró necesario relevar la afectación a estos derechos a través de medios virtuales y presenciales durante la semana del 20 al 25 de julio, y continuará las semanas siguientes. Establecimos una Mesa de Trabajo con el titular del ENRE, Federico Basualdo, para la resolución de casos urgentes en materia de mala facturación, cortes de luz y riesgo eléctrico. De igual manera con la titular de AySA, Malena Galmarini.
En una semana de relevamiento se recopilaron 385 casos testigo de problemas con el servicio eléctrico, en dónde los distritos más afectados son: La Matanza, Escobar y Florencio Varela. El informe realizado, además, destaca la situación particular de Quilmes, uno de los distritos del AMBA con mayores vulnerabilidades en acceso a derechos en sus barrios populares.
La red de energía eléctrica formal no sólo es condición necesaria para poder llevar adelante la vida cotidiana y la conectividad telefónica y digital como forma de acceso a otros derechos en tiempos de ASPO, sino también es un servicio indispensable para proveer de calor a los hogares que no tienen conexión al gas natural, mientras se transita el invierno. Los derechos humanos de millones de personas en el Área Metropolitana de Buenos Aires están en riesgo si el acceso a la luz y al agua se ven interrumpidos, mal provistos, mal conectados y/ o se tornan una estafa y/ o una imposibilidad.
"El servicio eléctrico es un derecho humano, y allí hay una vulneración de tratados internacionales y de nuestra Constitución", planteó Gabriela Carpineti, Directora Nacional de Promoción y Fortalecimiento para el Acceso a la Justicia. Aseguro también que "Acceso a la Justicia tiene que estar allí, para evitar que haya ciudadanos de segunda, que tengan igualdad jurídica frente a las empresas y que logren la prestación del servicio de manera formal".
Por estos motivos, la línea de atención seguirá vigente en el área metropolitana. El servicio de atención para hacer el reclamo mediante los Centros de Acceso a Justicia se extiende:
