SENTENCE WAS HANDED DOWN BY MARCELA TRANSFEMICIDIO CHOCOBAR

The National Women's Institute (INAM) recognizes the commitment of the
Criminal Chamber of the First Judicial District of the Province of Santa
Cruz, with the Presidency of Dr. Jorge Daniel Yance, who handed life
sentence and for the first once implemented TRANSFEMICIDIO figure in the
case of Marcella Chocobar.
Again, the Argentina Republic is a pioneer in sentences that recognize
violations of the rights of women and LGBTI collective defense. Thus, the
figure of transfemicidio is established in national jurisprudence with this
exemplary ruling, which stresses: "... Marcela case this was not just
murder but has all the features of a transfemicidio because We do not
forget that Marcela was not only autopercibía as a woman, but also made the
corresponding change of identity. "
Similarly, the judgment recepta the arguments in the Amicus Curiae
presented by the INAM and incorporates the gender perspective into its
foundations to "condemn Oscar Humberto Biott to find him for the crime of"
qualified hate homicide identity gender "committed on September 6, 2015 to
life imprisonment" and "Angel condemn Emanuel Azzolini to find him for the
crime of" aggravated concealment "and sentenced to six (6) years in prison."
In the same line of commitment, Dr. Jorge Daniel Yance asks the Superior
Court that the figure of Amicus Curiae can be incorporated into the process
in any instance. This expands the possibilities of the Agency, which aims
to provide a gender perspective in each causes, through their participation
in oral discussions and written submissions for possible rights violations.
Finally, Yance also makes specific mention of the National Institute for
Women and refers the sentence.
"This sentence shows that when gender perspective is adopted, there is true
justice," said Fabiana Tuñez, the Executive Director of INAM.
