El operativo se inició esta mañana cuando el guardacostas de Prefectura avistó al pesquero chino en plena actividad, con sus luces de faena encendidas, artes de pesca desplegadas y en funcionamiento, por lo que se puso en ejecución el protocolo de disuasión para que cesara la actividad de pesca y pudiera ser inspeccionado por una DOTACION DE VISITA. En primer término se efectuaron reiteradas llamadas por radiofrecuencia (en español y en inglés) y se realizaron señales sonoras y visuales para hacer contacto con el capitán. Sin embargo, el buque apagó sus luces de pesca e inició su navegación hacia aguas internacionales, sin responder a los permanentes llamados por distintas frecuencias del servicio móvil marítimo, por lo que se inició su persecución. Como apoyo para la operación del guardacostas Fique, decoló del Aeropuerto de Comodoro Rivadavia, el avión patrullero marítimo PA-22 de la Prefectura, que voló hacia la zona. El guardacostas continúo la navegación sin perder el contacto visual del buque pesquero, resultando infructuosas las comunicaciones radiales emitidas para que el capitán depusiera su actitud. Ante esto y siguiendo estrictamente el protocolo de actuación de la República Argentina, basado en lo establecido en la Convención de las Naciones Unidas sobre el Derecho del Mar (CONVEMAR), el guardacostas continuó la persecución mar adentro. Luego de varias horas de operativo, y en medio de un temporal muy fuerte de viento y olas, habiendo obtenido todas las pruebas respaldatorias y técnicas para determinar la posición e identificación del buque, se decidió dar por finalizada la operación, con el fin de resguardar la vida de las tripulaciones de ambas embarcaciones. Se inició sumario administrativo y judicial por presunta infracción al Régimen Federal de Pesca, Ley 24. 922 y por resistencia a la autoridad dentro de la Zona Económica Exclusiva Argentina. Interviene en el hecho el Juzgado Federal de Primera Instancia Nº 2 de la Ciudad de Rawson, a cargo del Dr. Gustavo Lleral, Secretaria Penal a cargo del Dr. Juan Matias González Mazziotti.
