OPENING RESULTS OF EVALUATIONS LEARNING
The Agency summoned to the Ministry of Education, Culture, Science and
Technology to deliver the results by school in Buenos Aires of Learning
assessment.

Someone asked the Ministry of Education, Culture, Science and Technology
access to the results of evaluations of the device "Learn" educational-Test
of each of the schools in the city of Buenos Aires performance. The agency
rejected the request arguing that the results are only published at the
jurisdictional level in order to avoid stigmatizing schools and to give
shelter to the compromised statistical confidentiality.
The Agency determined by Resolution 80/2019 that the information required
in the case does not refer to data that had been obtained and used by the
administrative authority subject to strict confidentiality and statistical
purposes only, but are data closely related with the exercise of their
public management of state resources and public policy design, so do not
apply to the case the provisions relating to statistical confidentiality.
The agency also found that the public interest involved in delivering the
information set undoubtedly a guarantee to implement the fundamental right
to education. Thus, access to information concerning the operation and
performance of educational institutions stands as a prerequisite or
indispensable tool for realizing the right to quality education in
conditions of equality and non-discrimination. Far from stigmatizing,
social control of state decisions can contribute significantly to assess
the efficiency and equity of social policies.
